This is on behalf of my girlfriend, who just called me in a fume about having a problem with a vendor at her Martial Arts school, where she works part time.Ok, she saw a flashing "Do you wish to upgrade now?" message for her school's CRM software. Feeling ill, and remembering the upgrade from V6 to V8 was free, she simply went ahead and clicked "Yes". She downloaded the software, installed the upgrade from V8 to V10 (they increment version numbers in 2's, apparently). That's all.She duly calls for support on a new business-critical function, and hey presto, Customer Services puts her through to Sales, where the guy tells her her school would have to shell out another 1200 USD if she wants the functionality. She says, "No thanks, I'll go back to Version 8). Sales guy says, "Sorry, you were given 8 as a freebie, but we don't give out free upgrades any more; it's $2k if you want Version 8). She can't go back to Version 6, as the data written in 8 can't be read by 6 (presumably some changes to table structure).Now, she went ahead and paid the first month, $99, but understandably she feels she was railroaded into this. Being a nice boyfriend (and a well-heeled DBA) I offered to pay off the remaining instalments for her, so she won't feel bad, but she wants to fight this one out.Now, what do you guys say about her case? According to US Law, isn't the vendor obliged to notify the client of extra costs? Thanks,Jaybee. |

Well she'd have to prove her case by looking at the fine print in the contracts, documents, or things she clicked on when doing the original or new installation. I'm going to have a go at the insurance company for a vehicle.I phoned them yesterday to make a change and they asked me the normal "security questions" - age, address, stuff like that. And then "I just have two further security questions, your Email address and mobile phone number" I went ballistic "I never EVER give out those details to insurance companies it is totally impossible that you have that information on record" and she then calmly asked me something else instead.They are quite clearly on a fishing mission for that data - I don't have a problem with them asking for that data - but pretending its a "Security question"? I don't think so ... time to write to the Insurance Ombudsman ...Kristen |

Kristen, is it "totally" impossible that they have that data - or is it just a "little bit" impossible? Ok, meet you in the middle, is it "Halfway" impossible?:)As it's just good, ol'fashioned plain impossible, you have a good case for getting someone fired, if they're screwing up on security questions, what other aspects of security are they botching? I'd be hopping too.Tara - thanks for that, I'll collate some more opinions but I agree with you, she'll most likely find the answer in the T's and C's of the contract. |
