If I setup mirroring do I need a license for both servers or just the live server? We currently use Oracle and I'm trying to advocate a switch to SQL Server. With Oracle you don't need a license for the non-live server and the license transfers to the failover server from the failed server when the live server fails. Is it the same for SQL Server?

Also, please confirm that a license is not required for dev and test servers.

It depends on your agreement with MS.

I don't understand. Does that mean we have to negotiate it with Microsoft? They don't have a formal policy on it? We don't currently have an agreement with Microsoft and I need to know the answer to this in order to further my argument to switch.

Yes, you need license for them if don't use developer edition nor express.

Normally you would need a server license for the mirrored servers. You can negotiate this with them though like we did if you have a large enough MS shop like we do.

Note that for your dev/test servers, you need a developer edition license for each developer. Developer edition licenses are not server licenses, each client must be licensed.
